T&C Events
Article 1 (Name, etc.)
This Academy shall be called “INIESTA ACADEMY” (hereinafter referred to as “the Academy”), and shall be organized, supervised and operated by INIESTA METHODOLOGY ACADEMY Co.
Article 2 (Purpose)
Under the program supervised by Andres Iniesta (hereinafter referred to as “the Program”), the purpose of the Academy is to improve and spread the technical and tactical skills of soccer, and through soccer to develop sportsmanship, a proper understanding of sports, sound development, and to contribute to the promotion of local communities.
Article 3 (Event Participation Procedures)
1. A parent or guardian of an event applicant for the Academy (hereinafter referred to as “Subscriber”) shall apply for the Academy by agreeing to these Rules, the Personal Information Protection Policy, and any other rules and regulations designated by the Company (hereinafter collectively referred to as “Rules and Regulations”) in accordance with the prescribed procedures.
2. In the event that the Company accepts the application in the preceding paragraph, the event applicant (hereinafter referred to as “Academy Student”) may participate in the practice from the date separately determined by the Company.
3. In the event of any of the following, the Company may not accept the application for admission to the Academy.
(i) When the Company judges that it is difficult for the Academy student to continuously participate in the practice in light of his/her health condition or athletic ability.
(ii) When the number of applications exceeds the maximum number.
(iii) In any other cases where the Company deems the application for theAcademy to be inappropriate.
Article 4 (Participation Fee, etc.)
The contractor shall pay the prescribed event participation fee as separately determined.
Article 5 (Non-Refund of Membership Fees, etc.)
In principle, once the participation fee has been paid, it is not refundable except in the case of non-acceptance of participation.
Article 6 (Contents of Guidance)
The Company shall determine and implement specific instructional methods for the Academy in accordance with the Program.
Article 7 (Compensation for accidents)
1. In order to compensate for accidents that occur to Academy students on their way to and from the Academy or during their activities, the Company shall subscribe to the Group Comprehensive Compensation System Expense Insurance (Compensation Plan Exclusive for Comprehensive Regional Sports Clubs).
2. In the event that an accident occurs to a student on the way to and from the Academy or during activities, the Company shall compensate the student in accordance with the compensation rules of the aforementioned insurance. In the event of an accident, the subscriber must promptly notify the coaches, staff, or the Company.
Article 8 (Date, Time and Place of Practice)
1. The Academy’s practice dates and times shall be in accordance with the schedule of events established by the Company. The location of the Academy shall be separately notified to the subscriber at least 60 days prior to the date of the Academy.
2. In the event that the Company deems it impossible to hold practice sessions due to reasons beyond its control, such as reasons at the facility where the Academy is held (inadequate facilities, accidents in the neighbourhood, etc.), reasons of the coaches (sudden illness, unforeseen accidents, etc.), transportation strikes, natural disasters such as typhoons and earthquakes, and warnings issued, the Company may change the date and time or practice location, or the practice may be cancelled. In such a case, the Company shall notify the subscriber in advance, except in the case of an emergency or unavoidable circumstances, and in the case of a change of date, time or place, the Company shall notify the subscriber separately.
Article 9 (Items to be confirmed by the contractor
and school students)
1. The Contractor and the Academy Students must strictly observe the following items, and the Contractor must supervise the Academy Students to ensure that the Academy Students observe the following items.
(i) To strive to ensure that all Academy students become familiar with and enjoy soccer with the spirit of fair play as their motto
(2) Endeavor to follow the purpose of the Academy.
(iii) When participating in events, to comply with these Rules and Regulations and other rules stipulated separately by the Company, and to follow the instructions of the Academy’s coaches and staff
(iv) Understand that all rights related to the Program belong to the Company or third parties who have granted the Company permission to use their rights, and not to record (including by audio or video recording), reproduce, publicly transmit, or distribute the contents of the Program or specific training methods, or engage in any other acts that infringe the Company’s rights.
(v) Not to take photographs (including still and moving images) of the event, etc. without the Academy’s permission.
(vi) To treat the facilities and equipment used for the event with care in accordance with the various rules and regulations, and not to cause any inconvenience to other users.
(vii) When the contractor accompanies the academy students during the event, the contractor shall follow the instructions of the coaches or staff of the Academy and support the academy students in a moderate manner.
(viii) When the contractor accompanies the academy students to and from the training site or picks them up, the contractor shall observe traffic laws and manners, and shall not cause trouble to the people around him or her.
(ix) If an Academy student is a pre-school child, the contractor or a person designated by the contractor shall take the child to and from the practice site.
2. If the contractor or an academy student violates any of the items in the preceding paragraph, and the academy judges that it is a hindrance to the proper operation of the academy, the academy may stop providing instruction to the academy student in question.
Article 10 (Cancellation Policy)
If you wish to cancel after registering for an event, you must notify us at least 30 days prior to the event date. If the request is made between 29 and 15 days prior to the event date, 50% of the event fee will be refunded. If the request is made 14 days prior to the event date, the event fee will not be refunded.
If you wish to re-register for the event, you will need to pay the registration fee again.
Article 11 (Matters to be Changed for School Students)
The subscriber must promptly notify the Company of any change in address, contact information, or any other information notified at the time of the application procedure, in accordance with the prescribed method.
Article 12 (Expulsion)
If an Academy student or subscriber falls under any of the following items, or is otherwise deemed by the Company to be unqualified as a member, he/she may be expelled from the Academy.
(1) When a person violates these Terms of Use
(2) When a person slanders or defames the Company, this academy or its related parties (including other academy students and their guardians)
Article 13 (Exemption from Liability)
1. Compensation for theft, injury, or other accidents of Academy students during their activities and on their way to and from the Academy shall be in accordance with the compensation rules of the insurance as stipulated in Article 7-1, and no compensation shall be made for theft, injury, or other accidents not stipulated in the said compensation rules, unless it is clear that the accident is attributable to our responsibility.
2. The Academy shall not compensate for any theft, injury or any other accident to any person other than Academy students.
3. The Company’s responsibility in the Academy shall be limited to providing the Academy Students with soccer instruction under the Program and practice support deemed necessary by the Company, and shall not guarantee the achievement of any specific purpose or results, etc. to the Academy Students or
Subscribers.
Article 14 (Discontinuance and Suspension)
1. The Company may suspend or discontinue the Academy in the event of natural disasters, changes in social conditions, or when the Company deems it difficult or impossible to operate the Academy. The Company shall not be liable for the suspension or discontinuation of the Academy except for reasons attributable to the Company.
2. when the Company suspends or discontinues the operation of the Academy pursuant to the preceding paragraph, the Company shall notify the Subscriber to that effect in advance. However, this shall not apply in case of emergency or unavoidable circumstances.
Article 15 (Use of Photographs and Video Images)
The Subscriber agrees that photographs and videos taken of the Academy’s activities may be used on the Academy’s or the Company’s website or for other promotions related to the Academy or the Company.
Article 16 (Prohibition of Transfer)
The Subscriber may not assign, succeed, or offer as security to a third party all or part of the rights which the Subscriber has against the Academy under these Terms and Conditions or the obligations which the Subscriber owes to the Academy.
Article 17 (Handling of Personal Information)
1. “Personal Information” means information concerning a subscriber and academy students (including prospective members) that identifies a specific subscriber or academy student by e-mail address, name, or other description.
2. The Academy shall handle personal information concerning Subscribers and Academy students (including prospective members; the same shall apply hereinafter in this Article) in accordance with the Academy’s Personal Information Protection Policy, which is separately stipulated. The Academy shall handle personal information of subscribers and academy students in accordance with the privacy policy separately stipulated.
Article 18 (Compensation for Damages)
1. If the Subscriber or an Academy student violates the Terms and Conditions or causes damage to the Company due to misconduct, the Company may demand compensation for damages from the Subscriber.
2. If the Subscriber or an Academy student causes damage to a third party in connection with the use of facilities or equipment used for practice or events, etc., the Subscriber shall be responsible for resolving such damage and shall not cause trouble to the Company.
Article 19 (Settlement of Disputes)
1. If any dispute arises between the Subscriber and the Company in relation to these Terms and Conditions or the Academy, both parties shall attempt to resolve the dispute through mutual consultation in good faith.
2. In the event that a lawsuit is necessary to resolve a dispute under the preceding paragraph, the dispute shall be governed by the laws of Japan and the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.
Article 20 (Supplementary Provisions)
The Academy may amend these Terms and Conditions as necessary, and may establish detailed regulations for matters related to these Terms and Conditions or matters not stipulated in these Terms and Conditions. In the event of modification of these Terms and Conditions, the Academy shall specify the effective date, and shall give notice of the modification of these Terms and Conditions, its contents and effective date on the Academy’s website or by other methods specified separately by the Academy.
Article 21 (Entry into Force)
This Agreement shall enter into force on January 31, 2023.
