Article 1 (Name, etc.)
This Academy shall be known as the INIESTA ACADEMY (hereinafter referred to as the “Academy”) and shall be organised, supervised and operated by INIESTA METHODOLOGY ACADEMY Co.
Article 2 (Purpose)
The Academy, under the programme supervised by Andrés Iniesta (hereinafter referred to as the ‘Program’), shall strive to improve and promote technical and tactical football skills, as well as to develop sportsmanship through football, deepen a proper understanding of the sport, promote sound development and contribute to the promotion of local society. The aim of the association is to contribute to the promotion of the local community.
Article 3 (Admission procedures)
1.The parent or guardian of a person who wishes to make a trial in the Academy (hereinafter referred to as the “Subscriber”) shall accept these Regulations, the Personal Data Protection Policy and other rules and regulations specified by the Company (hereinafter collectively referred to as the “Regulations”) and shall apply for membership in accordance with the established procedures.
2.If the Company accepts the application in the preceding paragraph, the prospective member (hereinafter referred to as “Academy Trainee”) may participate in the training from the date specified separately by the Company.
3. In the event of any of the following events, the Company may refuse admission to the Academy.
(i) Where the Company judges that it is difficult for the Academy Student to participate
continuously in practice in light of his or her health condition or athletic ability.
(ii) Where the number of applications exceeds capacity.
(iii) In any other case where the Company deems the application inappropriate for the Academy.
Article 4 (Content of instructions)
The Company shall determine and implement the specific teaching methods of the Academy in accordance with the Programme.
Article 5 (Accident Compensation)
The Company shall subscribe to the Comprehensive Group Compensation Plan Expense Insurance (Compensation Plan exclusively for Regional Comprehensive Sports Clubs) in order to compensate for any accidents that may occur to Academy students on their way to and from the Academy or during activities.
In the event of an accident to a student on the way to and from the Academy or during activities, the Company will compensate the student in accordance with the compensation rules of the said insurance. In the event of an accident, the contracting party shall immediately inform the
trainers, the staff or the Company.
Article 6 (Dates and places of practice)
1. The dates and times of practice for the Academy event shall be in accordance with the schedule established by the Company.
2. In the event that the Company deems it impossible to hold the practice due to reasons of the facility where the Academy is held (inadequate facilities, accidents in the neighbourhood, etc.), reasons of the Coach (sudden illness, unforeseen accidents, etc.), transportation strikes,
natural disasters such as typhoons and earthquakes, warnings issued or other force majeure causes, the set practice date, time or place may be changed, or the practice may be cancelled.
In such a case, the Company shall notify the Subscriber in advance, except in case of emergency or unavoidable circumstances, and shall notify the Subscriber separately in case of change of date, time or place.
Article 7 (Matters to be confirmed by the Contractor and students of the Academy)
1. The Contractor and the Academy students must strictly observe the following points, and the
Contractor must supervise the Academy students to ensure that they comply with them.
(i) To endeavour to ensure that the spirit of fair play is the watchword and that all Academy Students become familiar with and enjoy football.
(ii) Strive to follow the objectives of the Academy.
(iii) When participating in practices or events, etc., to comply with these Rules, etc. and the rules separately stipulated by the Company, and to follow the instructions of coaches or Academy staff.
(iv) Understand that all rights relating to the Programme belong to the Company or third parties who have granted the Company permission to use their rights, and refrain from recording (including by audio or video recording), reproducing, publicly transmitting or distributing the
contents of the Programme or specific training methods, or any other act that infringes the Company’s rights.
(v) Not take photographs (including still and moving images) of practices or events without the permission of the Academy.
(vi) Treat the facilities and equipment used for practice or events with care and in accordance with the various rules, and not to cause a nuisance to other users.
(vii) When the Subscriber accompanies the Academy student during the practice or event, the Subscriber shall follow the instructions of the coaches or Academy staff and support the Academy student in a moderate manner.
(viii) When driving Academy students to and from the training venue or picking them up, he/she shall observe traffic laws and manners, and shall not cause trouble to those around him/her.
(ix) If the academy student is a pre-school child, the contractor or a person designated by the contractor shall take the student to and pick up the student from the training site.
If the contractor or an academy student breaches any of the points in the above paragraph and is deemed to hinder the smooth running of the academy, the academy may suspend instruction to the academy student concerned.
Article 8 (Disclaimer)
1. Compensation for theft, injury and other accidents during the Academy Student’s activities
and en route to and from the Academy shall be in accordance with the insurance compensation regulations as stipulated in Article 7, Clause 1, and the Company shall not compensate for any theft, injury and other accidents not stipulated in such compensation regulations, unless it is
clear that the accident was caused by reasons attributable to the Company.
2. The Academy shall not compensate any theft, injury or other accidents to persons who are not students of the Academy.
3. The Company’s responsibility at the Academy shall be limited to providing Academy Students with Programme-based football instruction and practice support as the Company deems necessary, and shall not guarantee the achievement of specific objectives or results etc. to Academy Students or Subscribers.
Article 9 (Cancellation and Suspension)
The Company may suspend or discontinue the operation of the Academy in the event of natural disasters, changes in social conditions or when the Company deems it difficult or impossible to
operate the Academy. The Company shall not be liable for the suspension or interruption of the Academy, except for reasons attributable to the Company.
Where the Company suspends or discontinues the operation of the Academy in accordance with the preceding paragraph, the Company shall notify the Subscriber to that effect in advance.
However, this shall not apply in the case of emergency or unavoidable circumstances.
Article 10 (Use of photographs and images)
The Subscriber agrees that photographs and videos of the Academy’s activities may be used on the Academy’s or the Company’s website and Social Media or for other promotions related to the Company. In particular, the students of the Academy and their legal guardians accept and authorise the capture and fixation of their image and voice so that it can be published on the Website and Social Networks of the Academy or the Company for the normal dissemination and publicity of the activities of the same.
In case of disagreement with the terms of this clause, the legal guardians of the minor may write to the Academy or the Company in order to revoke this authorisation.
The Company accepts no responsibility for any problems that may arise between clients due to the taking of photographs or the uploading of photographs to social networking sites.
Article 11 (Prohibition of transfer)
The Subscriber may not assign, cause a third party to assign or offer as security all or part of its rights to the Academy or its obligations to the Academy under these Terms and Conditions.
Article 12 (Handling of Personal Information)
1. “Personal Information” means information concerning the Subscriber and students of the Academy (including prospective members). (1) “Personal Information” means information concerning Subscribers and students of the Academy (including prospective members; hereinafter the same shall apply in this Article) that can identify a specific Subscriber or student
of the Academy by email address, name or other description (meaning information that can be easily cross-referenced with other information and thereby identify a specific Subscriber or student of the Academy).
2. The Academy shall treat personal information relating to Subscribers and Academy Students in accordance with the separately stipulated Privacy Policy.
Article 13 (Compensation for Damages)
1. If the Subscriber or an Academy Student violates these Terms and Conditions or causes damage to the Company due to a wrongful act, the Company may demand compensation for damages from the Subscriber.
2. If the Subscriber or an Academy Student causes damage to a third party in connection with the use of facilities or equipment used for practice or events, etc., the Subscriber shall resolve the matter on his own responsibility and shall not cause trouble to the Company.
Article 14 (Dispute resolution)
1. If a dispute arises between the Subscriber and the Company in relation to these Terms and Conditions or the Academy, both parties shall attempt to resolve the dispute in good faith through consultation.
2. If a court action is necessary to resolve the dispute in the preceding paragraph, Japanese law shall be the applicable law and the Tokyo District Court shall be the court of exclusive jurisdiction of first instance.
Article 15 (Entry into force)
These Terms and Conditions shall enter into force on 1 March 2022.
